Your privacy matters. This Privacy Policy explains how Coach Cally Consultancy OPC collects, uses, stores, shares, and protects personal data when you visit our website, submit an inquiry, or schedule a discovery call.
Scope and who we are
Coach Cally Consultancy OPC ("Coach Cally Consultancy," "we," "us," or "our") is a Philippine corporation that provides corporate training, executive and personal coaching, and consulting and advisory services. For purposes of Republic Act No. 10173, or the Data Privacy Act of 2012 (the "DPA"), we act as the personal information controller for personal data when we determine how and why to process.
This Privacy Policy applies to personal data processed through meta.coachcallyconsultancy.com (the "Site"), its inquiry and booking pathways, and discovery calls arranged through the Site. It does not govern a third party's independent processing on its own website or platform.
Personal data we collect
INFORMATION YOU PROVIDE
Depending on how you interact with us, you may provide:
• Contact information, such as your first name, full name, email address, telephone number, organization, role, or location, when voluntarily provided.
• Booking information, such as your preferred date and time, time zone, email address, and responses to scheduling questions submitted through Zoom Scheduler.
• Inquiry and service information, such as the service you are interested in, your goals, organizational needs, participant details, proposed dates, budget information, and the contents of your message.
• Discovery-call information, including professional, organizational, or personal circumstances that you choose to discuss so we can understand your needs and assess whether our services are appropriate.
• Client and engagement information, if you proceed with a service, including information needed to prepare proposals, agreements, schedules, invoices, training or coaching materials, and related communications.
SENSITIVE PERSONAL INFORMATION
Coaching or personal-development inquiries may sometimes include information that the DPA treats as sensitive personal information. Please do not submit health, financial, government-issued identification, or other highly sensitive information through the general website form unless it is necessary and we have asked you to provide it through an appropriate channel. When sensitive personal information is necessary, we will process it only under an applicable lawful basis and with additional safeguards.
INFORMATION COLLECTED AUTOMATICALLY
The Site's hosting, security, and technical service providers may automatically receive limited technical information needed to operate and protect the Site, such as IP address, browser and device type, operating system, date and time of access, referring page, server logs, and security events. We do not currently use Google Analytics, Meta Pixel, advertising pixels, or similar non-essential analytics or behavioral advertising tools.
How we use personal data
We may use personal data for the following legitimate and disclosed purposes:
• To receive, review, and respond to inquiries and requests.
• To schedule, confirm, reschedule, and conduct discovery calls through Zoom.
• To understand your goals, assess service fit, and prepare customized proposals, recommendations, or engagement plans.
• To enter into and administer training, coaching, consulting, or advisory engagements.
• To send service-related communications, appointment confirmations, reminders, and necessary follow-ups.
• To maintain business, contractual, accounting, and administrative records.
• To protect the Site, our systems, our clients, and other users against fraud, misuse, unauthorized access, and security incidents.
• To establish, exercise, or defend legal claims and comply with lawful requests, legal obligations, and regulatory requirements.
• To maintain and improve the Site and our service processes using operational feedback and necessary technical information, without behavioral advertising or profiling.
We do not currently operate a newsletter or use a newsletter provider. We do not use information submitted for a discovery call to enroll you automatically in mass-marketing communications. If we introduce newsletters or promotional email campaigns later, we will provide a separate opt-in where required and update this Privacy Policy.
Lawful bases for processing
We process personal data only when permitted by applicable law. Depending on the circumstances, our lawful basis may include:
• Consent, when you freely and knowingly agree to a specified processing activity and may withdraw that consent, subject to lawful limitations.
• Contract or pre-contract steps, when processing is necessary to respond to your request, prepare an engagement, or perform our agreement with you or your organization.
• Legal obligation, when processing is necessary to comply with applicable law, regulation, lawful orders, tax, accounting, or regulatory requirements.
• Legitimate interests, when processing is reasonably necessary for lawful business operations, service administration, security, or the protection of legal rights, and those interests are not overridden by your rights and freedoms.
• Another lawful basis, when specifically permitted under the DPA for personal or sensitive personal information.
Where processing relies on consent, withdrawing consent will not affect the lawfulness of processing already completed before withdrawal. Certain information may still need to be retained or processed under another lawful basis.
Zoom scheduling and discovery calls
We use Zoom and Zoom Scheduler to arrange and conduct discovery calls. When you use Zoom's scheduling or meeting services, Zoom may process registration, contact, device, network, and usage information under its own terms and privacy statement. Zoom may process information using systems or service providers located outside the Philippines.
For more information about Zoom's practices, please review the Zoom Privacy Statement.
A discovery call will not be recorded unless you are informed before recording begins and any consent required by law is obtained. Please avoid sharing information that is unnecessary for the purpose of the call.
Cookies and similar technologies
We do not currently use non-essential analytics cookies, advertising cookies, or cross-site behavioral tracking tools on the Site. Essential cookies or similar technologies may nevertheless be used by the Site's hosting and security services to load pages, maintain security, prevent abuse, and support basic functionality. Zoom may also use cookies when you open its scheduling or meeting pages.
You may manage cookies through your browser settings. Blocking essential or third-party cookies may affect certain functions, including the ability to schedule a discovery call. If we introduce non-essential analytics or advertising technologies later, we will update this Policy and provide any consent mechanism required by law before activating them.
When we share personal data
We do not sell or rent personal data. We may disclose only what is reasonably necessary to:
• Service providers, including website hosting, security, business email, Zoom scheduling and videoconferencing, document storage, and other providers that help us operate our business.
• Professional advisers, such as lawyers, accountants, auditors, or insurers, when reasonably necessary and subject to professional or contractual confidentiality.
• Government agencies, regulators, courts, or law-enforcement authorities, when disclosure is required or permitted by law or necessary to protect lawful rights and interests.
• A successor or transaction party, if our business undergoes a merger, reorganization, acquisition, transfer, or similar transaction, subject to appropriate confidentiality and legal safeguards.
• Another person or organization, when you direct or authorize us to make the disclosure.
We require service providers that process personal data on our behalf to protect it and use it only for authorized purposes, as required by applicable law and our arrangements with them.
International and cross-border processing
Some technology and cloud service providers, including Zoom, may store or process personal data in countries outside the Philippines. Those countries may have privacy rules that differ from Philippine law. When we arrange cross-border processing, we take reasonable steps to use reputable providers and appropriate contractual, organizational, and technical safeguards consistent with the DPA and applicable National Privacy Commission guidance.
How long we keep personal data
We keep personal data only for as long as reasonably necessary for the stated purpose or as otherwise permitted or required by law. Our general retention approach is:
• Inquiry and booking records that do not lead to an engagement: up to two years after the last meaningful interaction, unless a shorter period is appropriate or a longer period is needed for a lawful reason.
• Client and engagement records: for the duration of the engagement and afterward for as long as necessary to meet contractual, accounting, tax, professional, regulatory, or legal-claims requirements.
• Technical and security logs: for the period reasonably necessary for security, troubleshooting, and fraud prevention, subject to the relevant provider's retention settings and obligations.
When personal data is no longer needed, we will delete, destroy, anonymize, or securely dispose of it, subject to applicable law and reasonable technical limitations such as secure backup cycles.
Future online store
The Site does not currently operate an online store and does not currently collect online payment-card information. If we launch a store or digital checkout, we will update this Privacy Policy before collecting purchase or payment information, identify the relevant payment or e-commerce providers, and provide any additional notice or consent required by law. Payment-card details would ordinarily be processed directly by the selected payment provider rather than stored by us, unless expressly disclosed otherwise.
Children and minors
The Site is not designed primarily for children, but it is not restricted exclusively to adults. Visitors under 18 should use the Site and submit personal data only with the knowledge and guidance of a parent or legal guardian. A parent or legal guardian should submit inquiries, arrange discovery calls, and enter into service engagements on behalf of a minor.
We do not knowingly seek to collect personal data directly from a minor without appropriate parental or legal guardian involvement. If you believe a minor has provided personal data without such involvement, please contact us so we can review the situation and take appropriate action, which may include deleting or restricting the information. Parents and legal guardians may exercise applicable privacy rights on behalf of a minor. If we later offer a service specifically directed to children, we will provide clear, age-appropriate privacy information and apply heightened privacy protections.
Security and personal data breaches
We use reasonable and appropriate organizational, physical, and technical safeguards designed to protect personal data against accidental or unlawful destruction, alteration, loss, misuse, unauthorized access, disclosure, or processing. These measures may include access restrictions, password-protected accounts, reputable service providers, confidentiality obligations, secure disposal practices, and periodic review of our data-handling procedures.
No website, internet transmission, or storage system can be guaranteed to be completely secure. If a personal data breach occurs, we will assess it and provide notifications to the National Privacy Commission and affected individuals when required by applicable law.
Your data privacy rights
Subject to the DPA and lawful limitations, you may exercise the following rights concerning your personal data:
• Right to be informed about how your personal data is collected and processed.
• Right to access personal data we hold about you and receive information about its processing.
• Right to object to certain processing, including processing based on consent or legitimate interests, where applicable.
• Right to rectify inaccurate or incomplete personal data.
• Right to erasure or blocking when the legal requirements for deletion, removal, or restriction are met.
• Right to data portability for qualifying electronically processed information in a commonly used and structured format.
• Right to withdraw consent where consent is the applicable basis for processing.
• Right to file a complaint with the National Privacy Commission and seek damages when legally available.
HOW TO SUBMIT A PRIVACY REQUEST
Email info@coachcallyconsultancy.com with the subject line "Privacy Request." Please state your name, the email address connected with your interaction, the right you wish to exercise, and enough detail for us to understand the request. We may ask for reasonable proof of identity or authority before acting to protect personal data from unauthorized disclosure or deletion. We will respond within the period required by applicable law.
A request may be limited or declined when permitted by law, including when information must be retained to comply with a legal obligation, perform a contract, protect another person's rights, establish or defend legal claims, or verify the requester. We will explain the applicable reason when required.
You may also learn about your rights or file a complaint through the National Privacy Commission.
No solely automated decisions or profiling
We do not currently use personal data collected through the Site to make decisions about you based solely on automated processing, and we do not conduct behavioral advertising profiling. If this changes, we will update this Privacy Policy and provide the information and choices required by law.
Third-party websites and social media
The Site may contain links to Zoom, social media pages, or other third-party websites and services. Their privacy practices are governed by their own notices and are outside our control. We encourage you to review those notices before submitting personal data to them.
Changes to this Privacy Policy
We may update this Privacy Policy to reflect changes in our services, technology providers, data practices, or legal obligations. The revised version will be posted on the Site with a new "Last updated" date. When a change materially affects how we use previously collected personal data, we will provide additional notice or obtain consent when required by law.
